  1. The holiday to Jamaica promotion (‘Promotion’) is organised by Global Charities (as defined in the Global Charities Promotion General Terms and Conditions). The Promotion will run from Wednesday 5th June 2024 to Wednesday 31st July 2024 on Heart, Capital, Capital Xtra, Smooth, Classic FM, Gold, Radio X and LBC. Global Charities is the Promoter. The ‘Prize Donor’ mentioned in these Specific Rules is Sandals Resorts. 
  2. IMPORTANT: The Promotion is subject to these Specific Rules and the Global Charities Promotion General Terms and Conditions which are available here. Entry into the Promotion constitutes acceptance of these Specific Rules and the General Terms and Conditions.   

 

Details of the Promotion: 

3. To enter the Promotion, you must send a text message with the relevant keyword to one of the following radio stations’ shortcodes (the ‘Text Message Line’):

4. The Text Message Line will open at 06:00 on Wednesday 5th June 2024 and close at 09:00 on Wednesday 31st July 2024. Entries received before or after this time will not be included in the Promotion but may still be charged.  

5. We are not responsible for any latency experienced by your mobile phone network, which may delay the delivery of text messages to and/or from us. 

6. Text messages will be charged at standard network rates. Standard rate text messages to promotion shortcodes are not normally included in ‘inclusive’ packages and may be charged. If entry is made by text message, be sure to use the correct shortcode. In all cases, please check with your service provider for more details and charges. If you are not the bill payer, you must obtain the bill payer’s permission before entering. 

7. After entering the Promotion, you will receive a bounce back text message informing you that a voluntary charity donation to Global’s Make Some Noise (registered charity 1091657 (England & Wales) & SC041475 (Scotland)) of £5 will be taken automatically, unless you text the word CANCEL as instructed. The £5 donation will be taken one hour (60 minutes) after the time the first text was received from the mobile phone used to enter the Promotion, and 100% of the donation will go to Global’s Make Some Noise. 

8. For the avoidance of doubt, you do not need to donate in order to be eligible for entry to the Promotion. Anyone who texts CANCEL within 60 minutes, as instructed in the first bounceback message will opt out of donating £5 to Global’s Make Some Noise but will still be included in the prize draw. 

9. Within 3 hours of the closing time of the Promotion, all eligible entries will be entered into a draw. One entry will be selected at random and the entrant will be contacted by one of our representatives telephone on the number on which you entered. If the entry is ineligible, we reserve the right to select another entrant to participate in the Promotion or withdraw the prize and select another entrant, as applicable. 

10. If you are selected as a winning entrant, you may be asked to have a call with a presenter which may be recorded for our records and/or could be broadcast live or later in a show. You must answer your telephone when we contact you. Someone else cannot answer the phone, participate or accept a prize on your behalf. If: (i) you fail to answer the phone; (ii) someone else answers the phone; (iii) the call goes to voicemail; (iv) the call becomes disconnected; (v) you are not (or do not seem to us to be) in a position to safely and/or lawfully take or remain on the call (for example, if you are or seem to be driving); or (vi) you are not audible or intelligible or we are not able to conduct a conversation with you in a manner that is suitable for broadcast for any reason beyond our control (including, but not limited to: low/no signal on your device, a call is dropped by any network, you are travelling, there is too much background noise or feedback, etc.); before or during the Promotion, you may be disqualified and we reserve the right to select another entrant to participate in the Promotion or withdraw the prize and select another winner, as applicable.    

11. We, Global and the Prize Donor may publish and publicise your name, image, social media handle and/or profile picture, your nearest geographical location (for example, your nearest city, town or county) and your entry, and we may refer to your and any applicable third party’s (for example a guest/travel companion) association with the Promotion and/or the prize, in any and all media, worldwide, in perpetuity, for publicity and PR purposes solely in connection with the Promotion.   

12. In relation to winners (and runners up if applicable), you understand that we, Global and the Prize Donor may: (i) interview you and your guest(s)/travel companion(s) which we may film, photograph and/or record and; (ii) film, photograph and/or record, you and your guest(s)/travel companion(s) in connection with the Promotion, either by telephone or in person, and we may use such films, recordings and/or photographs for publicity and PR purposes in any and all media, worldwide, as often and for as long as we consider appropriate or desirable, in connection with the Promotion. We may also publish your and your guest(s)/travel companion(s) name, image, social media handle and/or profile picture. 

13. We may send you a message via SMS within 28 days of your donation regarding adding Gift Aid to your donation. 

Eligibility: 

 14. The Promotion is only open to residents of the UK aged 18 and over and who are based in the UK at the time of entry. 

15. Entrants can enter up to 6 times only, however they must text CANCEL as instructed after each entry to opt out of donating £5 per entry to Global’s Make Some Noise.  

Prize specific terms:  

16. The Prize: One winning entrant will receive one seven-night (7), all-inclusive holiday for two (2) adults at Sandals Ochi Beach Resort, Jamaica in one deluxe room with a king size bed (subject to availability and selected blackout dates) and two (2) economy class return flights from London to Jamaica, subject to availability. The resort accommodations are inclusive of all meals, unlimited premium brand beverages, daily & nightly entertainment, an array of land and water sports activities, including scuba diving (for certified divers), snorkelling, Wi-Fi in all rooms and public areas, resort gratuities, resort taxes and resort transfers to and from the selected or designated resort’s airport. 

17. The Prize excludes: Domestic transfers, including any internal flights or transportation to London, spending money, telephone calls, car hire, Red Lane® Spa treatments and services, specialty dining, tours & excursions, inter-island transportation, SCUBA certification courses, island departure taxes and purchases made at the Sandals Resorts Specialty Shops. All expenses and incidental travel costs not expressly stated in the Prize package description, including but not limited to, all ground transportation (outside of local airport transfers in the Caribbean), travel insurance, passenger tariffs or duties, airline fees, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees and taxes. Holiday insurance, Covid tests, Visas and ESTAs are not included and must be purchased before travel, if required. 

18. The Prize Provider and Administrator of the Prize for Redemption Purposes only is: Unique Caribbean Holidays (UK) Ltd. an affiliate of the worldwide representative for Sandals Resorts, located 2nd Floor, Nucleus House, 2 Lower Mortlake Rd, Richmond TW9 2JA. 

19. There will only be one (1) winner. Prize winner and their travel companion must be over 18 and must travel on the same itinerary.  

20. Passports are required for international travel and must have at least six months validity from when your trip finishes (i.e. the date you travel home). 

21. The Holiday cannot be taken during peak seasons (Easter, July, August, December and New Year) and cannot be confirmed until 90 days prior to departure. Blackout dates and restrictions apply. Sandals Resorts’ Blackout dates include but are not limited to: 18th -29th November 2024, 18th – 31st December 2024, 1st – 3rd January 2025, 14th – 17th February 2025, 17th April – 4th May 2025, 1st – 7th July 2025. Once dates are confirmed there will be an administration fee for any changes made to the reservation. This fee varies in accordance with the airline.  

22. The Prize must be redeemed before 31st July 2025. Prize is strictly non-transferable; no cash alternative is available, and the prize cannot be redeemed for cash. If the winner is unable to redeem the Prize within the specified time the Prize will be forfeited.  

23. Sandals Resorts are for adults and all accommodations include one king size bed.

25. Sandals Resorts reserves the right to relocate the Prize winner from the stated resort to an alternative Sandals Resort if rooms become unavailable for the travel dates booked due to any circumstance beyond their control. Sandals Resorts reserves the right to substitute the selected resort for another resort in the selected resort’s chain in a similar category based on availability of space for the secured travel dates, and to change dates without prior notice for any circumstance(s) beyond the selected resort’s control and if such circumstance(s) so require. The Terms and Conditions agreed to shall apply with equal applicability to any resort, which is the subject of substitution or deviation.  Neither Unique Caribbean Holidays Ltd. (UCHL) nor Sandals Resorts shall be liable for any claim made whatsoever, including but not limited to loss, compensation, or refund by reason of such substitution or deviation. 

26. PRIVACY POLICY/USE OF DATA: ONLY THE NAME AND THE CONTACT EMAIL ADDRESS OF THE PRIZE WINNER WILL BE PROVIDED TO THE PRIZE PROVIDER. The UK version of the General Data Protection Regulation (EU) 2016/679 which is part of UK law by virtue of the European Union (Withdrawal) Act 2018, as supplemented by the Data Protection Act 2018;  provides a number of protections for use of your personal data.  Any personal data collected from the Prize Winner and provided to Unique Caribbean Holidays Ltd. as the Prize Provider and Administrator of the Prize for redemption purposes shall be subject to our privacy policy located at www.sandals.co.uk/general/privacy/.  The Prize Provider will only use the personal data of the prize winner and travel companion for the purposes of administrating the Prize redemption, unless the Prize winner and travel companion provide express consent signifying their agreement to any other processing or use of their personal data.  For Prize redemption purposes the personal data collected from the Prize winner and travel companion will be shared with the Prize Provider’s reservations affiliate and the resort which are both located outside of the United Kingdom.  

27. Employees and their immediate families of Unique Caribbean Holidays Ltd. and their associated agencies or affiliated companies are not eligible to enter to win. 

28. Each Entrant agrees and as a condition of possibly being awarded the Prize to release and hold harmless the Prize Provider and its affiliated companies and each of their respective officers, directors, employees, agents and insurers from and against any and all claims, causes of action and/or liability for any injuries, illness, death, loss or damage of any kind arising from or in connection with participation in and/or entry into the competition or receipt or possession, use or misuse of the Prize or any element thereof. 

29. Health & Safety: The health and safety of our guests is our number one priority, and the Hotel reserves the right to implement or modify health protocols, policies and procedures at any time as needed, in keeping with public health guidance and applicable law.  

30. Guests are responsible for checking the travel and entry protocols for the destination that they are travelling to before they depart and ensuring that they fully understand and comply with any such protocols. For example, some destinations may require all guests to be fully vaccinated and/or to obtain a negative PCR Covid-19 test a certain number of days pre-travel and post travel, to return to your original destination. Please visit the UK Foreign Commonwealth and Development Office (“FCDO”) website before travel and check the official Government website for the country you’re visiting for all pre and post travel protocols. Unique Caribbean Holidays Limited and Sandals Resorts International Ltd. shall not be responsible for any additional costs incurred for any required test or any other pre-travel or post-travel requirements.  

31. Compliance With Government Entities: The Unique Group, and Sandals Resorts International Limited and/or any of its related entities shall have the right to comply with any and all orders, recommendations, or directions whatsoever given by any government entity or by persons purporting to act with such authority, and such compliance shall not be deemed a breach of any agreement or any agreement entitling the guests to assert any claim for liability, compensation or refund. 

32. For competition winner trips inclusive of flights paid for by Unique Caribbean Holidays Ltd. (UCHL), any amendments and/or cancellation of a competition prize will be made in line with current travel policies at the time that the amendment and/or cancellation is made.  If the FCDO advises against travel to the destination that the prize winner is due to travel to, or if the destination closes its borders to commercial flights, or if flights are cancelled by the airline or if the entry protocols in the destination requires guests to quarantine in room, the trip may be cancelled by Unique Caribbean Holidays Ltd. If a guest cancels their trip without a valid reason, Unique Caribbean Holidays Ltd. reserves the right to charge the guest for any costs incurred as a result of the cancellation.   

33. All guests are required to provide evidence of comprehensive travel insurance before reservations are made for travel. Unique Caribbean Holidays Limited and Sandals Resorts International Ltd. will not provide comprehensive travel insurance. 

 35. CLASS ACTION WAIVER: THIS SECTION PROVIDES FOR THE EXCLUSIVE RESOLUTION OF DISPUTES THROUGH INDIVIDUAL LEGAL ACTION AND SUPERSEDES ANY LAW ENTITLING GUEST TO PARTICIPATE IN A CLASS ACTION. THIS CLASS ACTION WAIVER PRECLUDES GUEST FROM PARTICIPATING IN OR BEING REPRESENTED IN ANY CLASS OR REPRESENTATIVE ACTION REGARDING ANY CLAIM BROUGHT UNDER AS A RESULT OF ANY AGREEMENT. EVEN IF APPLICABLE LAW PROVIDES OTHERWISE, GUEST AGREES THAT ANY ARBITRATION OR LAWSUIT AGAINST ANY ENTITY UNDER THE UNIQUE GROUP AND/OR SANDALS RESORTS WHATSOEVER SHALL BE LITIGATED BY GUEST INDIVIDUALLY AND NOT AS A MEMBER OF ANY CLASS OR AS PART OF A CLASS ACTION, AND GUEST EXPRESSLY AGREES TO WAIVE AUTHORITY TO ARBITRATE CLAIMS ON A CLASS ACTION BASIS. IF GUEST’S CLAIM IS SUBJECT TO LEGAL PROCEEDING UNDER FOREIGN SELECTION AND CHOICE OF LAW PROVISIONS OF THE ACCOMMODATIONS, AMENITIES, TRANSPORATION AND OTHER PRODUCTS OR SERVICES TERMS AND CONDITIONS (available here: www.sandals.co.uk/terms-conditions/), THE GUEST FURTHER AGREES AND ACKNOWLEDGES THAT THE CLASS ACTION WAIVER IS MATERIAL AND ESSENTIAL TO THE PROCEEDING OF ANY DISPUTES BETWEEN THE PARTIES AND IS NON-SEVERABLE FROM THE AGREEMENT TO ANY CLAIMS HEREIN. THE VALIDITY AND EFFECT OF THIS CLASS ACTION WAIVER MAY BE DETERMINED ONLY BY A JUDGE OR COURT OF LAW. GUEST AGREES THAT THIS SECTION SHALL NOT BE SEVERABLE UNDER ANY CIRCUMSTANCES FROM THE FORUM SELECTION AND CHOICE OF LAW PROVISION SET FORTH IN THE TERMS AND CONDITIONS. Guest agrees that the parties referenced in FOREIGN SELECTION AND CHOICE OF LAW PROVISIONS OF THE TERMS AND CONDITIONS that may be the subject of any claim by Guest can receive immediate judicial assistance to enforce this class action waiver. 

36. Entrants should check the Gov.co.uk website for travel advice and other information prior to entering the competition. 

37. Any other costs and expenses which are not specifically included in the prize description are excluded and will be the sole responsibility of the winner. By way of example, without limitation, UK transfers, is not included within the prize. 

38. It is the responsibility of the winner and their guests to ensure that they are legally able to travel to the destination and have any necessary passports with appropriate validity time (e.g. valid for 6 months from the date you arrive), visas, or any other documentation. 

39. It is the responsibility of the winner to comply with any Covid-19 checks and tests for entering their travel destination and upon returning to the UK. Global Charities and Global will not cover the cost of any Covid testing and it is the complete responsibility of the winner and their travel companion to buy, organise and arrange these tests. Global Charities and Global will not be held responsible if the winner or their guests do not have the correct travel documentation, test results or if they breach any COVID-19 regulations.  

40. You acknowledge and agree that, without limitation to the provisions of Clause 12 of the Global Charities Promotion General Terms & Conditions, our ability to fulfil a prize and/or perform any of our obligations under the Promotion Terms and Conditions could be affected by an actual or threatened epidemic, pandemic, disease or quarantine and/or any corresponding governmental action, guidance and/or ruling (including but not limited to any Foreign, Commonwealth & Development Office guidance) (collectively ‘Covid Measures’).   

41. If due to any Covid Measures, we are unable to fulfil a prize or perform any of our other obligations under the Promotion Terms and Conditions, then we shall not be in breach of the Promotion Terms and Conditions. In accordance with Clause 32 below, in these circumstances, we reserve the right to substitute the prize with another prize of equal or greater value at our absolute discretion. 

42. Travel insurance is provided by the Promoter on an optional basis and is subject to normal terms of acceptance. Pre-existing medical conditions may not be covered. Travellers must be 74 years old or younger. It is the sole responsibility of the winner to check the Promoter’s travel insurance policy to ensure it provides the appropriate level of cover required. The travel insurance is provided to the winner on the understanding and agreement that it is only valid for the holiday prize described in this Promotion. Should the winner decide not to accept the Promoter’s travel insurance policy the responsibility will be on the winner to obtain suitable travel insurance for themselves and, where applicable, their guests. 

43. The prize is non-transferable, non-refundable and not for resale. 

44. This is a charity Promotion and as such no refunds are given. 

45. We reserve the right to substitute the prize with another prize of equal or greater value at our absolute discretion.

Data Protection: 

46. Your personal data that you provide to us will be collected and processed by us, Global, Global’s licensees (including Communicorp UK Limited), Global’s affiliates, our service providers, network operators and suppliers in order to administer and fulfil the Promotion. Your personal data may also be disclosed to the Phone-paid Services Authority, Ofcom and/or the Advertising Standards Authority at their reasonable request for regulatory purposes, for example, in order to prevent, investigate and detect crime, fraud or anti-social behaviour and comply with law enforcement agencies and applicable advertising codes. 

47. By entering a Promotion, you acknowledge that any personal data provided by you in connection with the Promotion will be processed as set out above and in accordance with our Privacy Policy which sets out full details of how we process personal data and how you can exercise your rights as a data subject. Please ensure you have read and understood our Privacy Policy before entering any Promotion. If you are required to submit a guest(s)/travel companion(s) personal data to enter a Promotion, you must ensure that your guest(s)/travel companion(s) have given you consent to provide us with their personal data. 

48. You may be asked if you want to opt-in to marketing from us when you enter a Promotion. If you choose to opt-in, we will use your personal data for marketing purposes (see Global Charities’  Privacy Policy for more details). You can withdraw your consent to marketing at any time by unsubscribing.  

49. We, Global may transfer and process personal data outside of the EEA and UK for the purposes of administering the Promotion. Where any transfers are made outside of the EEA or UK we will ensure appropriate safeguards to protect your personal data are in place.  

50. We and Global will hold your personal data for a period of up to 3 yearsin order to comply with our regulatory obligations.  

51. You may request the removal of your personal details from our database by contacting [email protected]. If you request that your personal details be removed prior to the conclusion of a Promotion, you will forfeit your right to enter the Promotion and/or claim any prize and we reserve the right to select another entrant to participate in the Promotion or withdraw the prize and select another winner, as applicable.
